New guidelines for the operation of the IMSS Mailbox

Last June 7 and August 5, 2024, agreements ACDO.AS2.HCT.230724/261.P.DIR were published in the Official Gazette of the Federation, whereby the general guidelines for the operation of the IMSS Mailbox were approved, as well as the list of available procedures and services.

 

The purpose of the IMSS Mailbox guidelines is to establish the basis for the digital notification of administrative acts and resolutions, facilitating the management of procedures and services related to social security.

 

Therefore, as of February 1, 2025, all individuals must enable the IMSS Mailbox through the web page www.imss.gob.mx/buzonimss, and for such purposes, at least one e-mail address and the cell phone number of the obligor must be registered, otherwise, those who do not enable the IMSS Mailbox will be notified through official documents. It is specified that the IMSS will carry out the notifications digitally, especially those resolutions that may be appealed, and for such purposes, they will be carried out between 9:30 a.m. and 6:00 p.m., according to the Central Zone of Mexico.

 

By means of the use of the e.signature of the promoter, which will produce the same legal effects as the documents signed by handwriting.

Registration and use of the IMSS Mailbox

The initial procedures available through the IMSS Mailbox include the downloading of the determination letters and the information on Service Contracts or Specialized Works (ICSOE). It will also be possible to receive notifications of administrative and tax acts, such as resolutions and fines related to Occupational Risk Insurance. Likewise, once the necessary technological adjustments have been made, other procedures will be enabled. For example, the rectification of the classification of companies, the suspension of administrative enforcement procedures and the unblocking of accounts. Finally, it is important that employers adapt to the use of the IMSS Mailbox and its guidelines to ensure compliance with their social security obligations and avoid penalties.

 

Previous Reform to the Social Security Law.

Remember that the Secretary of Labor and Social Welfare (STPS) published in the DOF, on June 7, 2024, in the evening edition, the Decree by which the Social Security Law (LSS) is reformed, regarding digital tools, effective as of June 8, 2024, in which it was established that the Social Security would have a term of 60 days, to disclose the procedures and services available in the IMSS Mailbox, as well as its general rules for its operation.

 

Sanctions.

Any non-compliance with these Guidelines shall be sanctioned in accordance with the General Law of Administrative Responsibilities, the Law, the Federal Criminal Code and other applicable legal provisions.

Validity.

These guidelines enter into force on August 6, 2024, so it is important that employers adapt to the use of the IMSS Mailbox and its guidelines, to ensure compliance with their social security obligations and avoid penalties.
